GENERAL TERMS AND CONDITIONS FOR THE PROVISION OF SERVICES

These General Terms and Conditions (“Terms”) govern the provision of Internet services by G‑NET (“the Company”) to the end-user (“Customer”). By using G‑NET’s services, the Customer agrees to the following:

1. Service Availability and Limitations

G‑NET provides Internet access on an “as is” and “as available” basis. The Company does not guarantee uninterrupted service, uptime, or specific performance levels (Service Level Agreement). Service may be affected by factors including but not limited to:

  • Power outages
  • Network or equipment faults
  • Weather conditions
  • Natural disasters
  • Accidents or sabotage
  • Wars, terrorism, strikes
  • Governmental actions or prohibitions
  • Legal or regulatory changes
  • Damage to public or third-party telecommunications infrastructure

The Customer understands and accepts that the service is not intended to serve as a primary or emergency (“life-line”) telecommunications service.

2. Installation and Reinstallation

By subscribing, the Customer authorizes G‑NET and/or its contractors to perform all necessary installation work at the specified premises. Standard installation includes:

  • Mounting of an external antenna and CPE (Customer Premises Equipment)
  • Installation of wiring and wireless transceiver devices

Any custom installation beyond the standard scope may be subject to additional charges. G‑NET is not liable for any aesthetic or physical alterations to the Customer’s premises (e.g. wall drilling, cable routing, mounting brackets), though all work will be performed with care and professionalism.

3. Line of Sight and Signal Obstructions

Wireless service requires clear Line of Sight (LoS) to G‑NET’s Access Point (AP). Service quality may be affected by:

  • Seasonal changes (e.g. foliage)
  • Construction of new buildings
  • Growing trees or other physical obstructions

G‑NET will make reasonable efforts to realign or relocate equipment if signal degradation occurs. However, the Company does not guarantee continued service in the event of line-of-sight issues.

4. Use of Service and Customer Responsibility

Use of the service is at the Customer’s own risk. The Customer is solely responsible for:

  • The content accessed or transmitted via the Internet
  • Ensuring appropriate restrictions for minors
  • Protection against viruses, malware, and other cybersecurity threats
  • Compliance with all applicable laws, including but not limited to GDPR, anti-pornography, defamation, or illegal content laws

G‑NET does not guarantee data security or accuracy of information accessed via the service. It is strongly recommended that Customers use updated antivirus and security software.

5. Customer Equipment

G‑NET is not responsible for loss, theft, or physical damage of outdoor or indoor installed equipment. Maintenance and support of customer-owned devices are limited to manufacturer warranty terms. The Company shall not be liable for:

  • Hardware or software damage
  • Configuration changes
  • Data loss or corruption
  • Unauthorized access due to unprotected devices

6. Indemnification

The Customer agrees to indemnify and hold harmless G‑NET, its owners, partners, employees, and contractors from any liabilities, claims, legal actions, costs, or damages arising from:

  • Use or misuse of the service
  • Equipment installation or removal
  • Violation of these Terms
  • Illegal or harmful activity conducted via the service

7. Modifications

G‑NET reserves the right to update these Terms at any time. Continued use of the service after such updates constitutes acceptance of the revised Terms.

8. Force Majeure

G‑NET shall not be liable for any delay or failure in performance of its obligations under this Agreement if such delay or failure results from circumstances beyond its reasonable control (“Force Majeure Events”), including but not limited to:

  • Natural disasters (e.g. storms, floods, earthquakes, fires)
  • Wars, hostilities, terrorism, sabotage
  • Strikes, labor disputes, or industrial disturbances
  • Power outages, utility failures, or disruptions in public telecommunications networks
  • Governmental acts, regulations, embargoes, or prohibitions
  • Epidemics, pandemics, quarantine restrictions
  • Damage, theft, or destruction of infrastructure by third parties

During any Force Majeure Event, G‑NET’s obligations shall be suspended to the extent affected. If the event continues for more than 30 consecutive days, either party may terminate the agreement without liability, by written notice.

Invoicing and Payments
Customers will be invoiced on the installation date for equipment delivery, installation fees, and the first agreed-upon service period. All payments are made in advance. After 30 days, payment is due to maintain service continuity. Customers will receive two SMS reminders (at 3 days and 1 day before expiration) if payment is pending. If payment is not received on time, the service will be interrupted without further notice. Service will be restored once the Customer prepays for the next period. If the Fiber Service remains unpaid for more than 15 days, G‑NET reserves the right to terminate it without additional notice.

Cancellation Policy
If a customer wishes to cancel the service, they must submit a written cancellation request, including the reason for cancellation, to info@g-netfiber.com at least 15 days in advance. G‑NET does not refund any “setup” or “installation” fees. The customer remains liable for all charges under these Terms until the agreement is formally terminated and acknowledged in writing by G‑NET. In cases of issues like stolen equipment or late payments, customers must notify G‑NET in writing; otherwise, charges will continue.

VAT Inclusion
All quoted prices include VAT.

As stated by N.M.E.S GIGANET HOTSPOTS LTD, G‑NET packages are intended solely for private, personal interpersonal communication. They may not be used for resale or for any commercial gain.
